An authorized representative for EPR in Croatia is mandatory for all entities that:

  • they are not based in Croatia,
  • in the course of their business they place on the Croatian market packaging, packaged products, electrical and electronic equipment or batteries and accumulators,
  • sell the aforementioned products to end customers (natural persons) in Croatia via distance selling (e.g. online shops, teleshopping, telephone orders, e-mail, etc.).

Operating in violation of EPR regulations can result in heavy penalties!

The obligation to appoint an authorized representative in Croatia arises from several national legal acts:

  • Packaging and packaged products – Regulation on packaging and packaging waste, single-use plastic products and fishing gear containing plastic (OJ 137/23),
  • Batteries and accumulators, electrical and electronic equipment – Regulation on the management of specific categories of waste in the Fund system (OJ 124/23),
  • General provisions – Waste Management Act (Official Gazette 84/21, 142/23).

The EPR regulations in Croatia and other Member States were introduced pursuant to Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain previous directives.

According to the definition provided by the Croatian EPR legislation, a manufacturer is an entity (natural or legal person) that develops, produces, processes, sells, imports, or places on the market of the Republic of Croatia packaging, packaged products, electrical and electronic equipment, or batteries and accumulators.

It’s important to note that a manufacturer is considered such only if they sell products to natural persons (consumers, Croatian citizens). If you sell your products exclusively to Croatian businesses, you are not subject to the EPR obligations and do not need to appoint an authorized representative for your company in Croatia.

The online platform (marketplace) through which distributors place products and packaging on the Croatian market is also considered a producer. If individual distributors fail to comply with their legal obligations under the EPR regulations and do not register with the Register of Producers with Extended Responsibility (RPPO), the online platform is responsible for their EPR obligations in Croatia.

Yes. All manufacturers selling packaging, packaged products, electrical and electronic equipment, or batteries and accumulators to end consumers in Croatia via online platforms are required to appoint an authorized representative for EPR in Croatia. Most sales portals require distributors to provide proof of appointing an authorized representative or information regarding compliance with extended producer responsibility obligations.

If you, as a distributor (manufacturer), do not appoint an authorized representative in Croatia, your EPR obligations will be assumed and fulfilled by the online platform you use.

    Understanding EPR Regulation in Germany

    The Extended Producer Responsibility (EPR) system in Germany was introduced in accordance with EU directives:

    • 2006/66/EC on batteries and accumulators (now Regulation 2023/1542 ),
    • 2012/19/EU on waste electrical and electronic equipment (WEEE).

    The German EPR regulations include, among others:

    • in accordance with the ElektroG law – waste electrical and electronic equipment (WEEE),
    • according to the BattG – batteries and accumulators.

    Companies that place WEEE or batteries on the German market must comply with numerous obligations to ensure proper waste management. These include:

    • registration with the competent authorities ( German Clearing House – EAR ) in order to obtain an EPR number,
    • periodic reporting of the quantities of WEEE and batteries placed on the German market,
    • organization of waste collection and management (through an EPR organization),
    • information requirements (adequate labelling, user instructions),
    • appointment of an authorized representative, if the company is not based in Germany.

    What is an Authorized Representative for EPR in Germany?

    An EPR Authorized Representative is a natural or legal person based in Germany who assumes the manufacturer’s obligations under the EPR regulations (ElektroG for EEE, BattG for batteries). The scope of these obligations depends primarily on the type of products sold.

    Only a company based in Germany, registered with the competent authority (EAR) and in possession of a written agreement with the manufacturer for the transfer of obligations arising from the EPR regulation, can act as the manufacturer’s authorized representative.

    Who is required to appoint an authorized EPR representative in Germany?

    The appointment of an authorised representative for the EPR in Germany is mandatory for all companies not based in Germany that place on the German market:

    • rechargeable batteries and accumulators,
    • products containing rechargeable batteries or accumulators,
    • electrical and electronic equipment (EEE).

    Foreign entities that sell products directly to end customers in Germany via distance selling channels (such as their own online shops or e-commerce platforms like Amazon, eBay, Zalando, etc.) must therefore necessarily have an authorized representative.

    Soon also for packaging compliance

    Currently, the obligation to appoint an authorized representative does not apply to companies selling packaging or packaged products on the German market. This obligation will come into force with the Packaging and Packaging Waste Regulation (PPWR) in August 2026. The PPWR will replace Directive 94/62/EC , which currently regulates EPR obligations relating to packaging.

    However, companies can already voluntarily appoint an EPR Authorized Representative to ensure full compliance with the PPWR, avoid penalties, and streamline regulatory processes. Although companies must register independently with the LUCID Packaging Registry , the Authorized Representative is responsible for fulfilling all other packaging-related obligations.

    EPR (Extended Producer Responsibility) is a concept whereby manufacturers are responsible for the entire life cycle of the products they place on the market, from design and production to waste management. Under EU directives, all Member States must integrate extended producer responsibility into their national legislation regarding:

    • packaging and packaged products,
    • electrical and electronic equipment (EEE),
    • batteries.

    The obligation to appoint an authorized EPR representative is stipulated in two German laws: the Electrical and Electronic Equipment Act ( ElektroG ) and the Battery Act ( BattG ). For packaging, the obligation is enshrined in EU law ( PPWR ) and will enter into force in all Member States by August 2026. Although the extended producer responsibility systems in the various EU Member States were developed based on the same European directives, their structure and operation differ significantly. Not only does each country organize collection differently, but local regulations are often not translated into other languages, making it difficult for foreign businesses to understand and comply with the EPR system in force in a given country. To ensure that foreign companies strictly comply with EPR regulations, each Member State can require them to appoint an authorized representative—a local entity who ensures that all producer obligations are fulfilled. In the German EPR system, this obligation currently only exists for batteries and electrical and electronic equipment, but will also become mandatory for packaging from 2026.

    An EPR Authorized Representative may be a natural or legal person who meets all of the following conditions:

    • has its residence or registered office in Germany,
    • is registered in the relevant register ( LUCID for packaging, EAR for electrical and electronic equipment and for batteries),
    • has entered into a written agreement with the foreign manufacturer for the transfer of EPR obligations.

    Manufacturers intending to sell batteries or electrical and electronic equipment to German customers must appoint an authorized EPR representative before starting their business. The authorized representative’s task is to take all necessary measures to ensure the products can be legally placed on the market, including the required registrations on behalf of the manufacturer, the provision of guarantees, and participation in the extended producer responsibility system. Businesses placing packaging and packaged products on the German market can currently appoint an authorized representative at any time, both before and during their business, but no later than August 2026, when this will become mandatory under the PPWR.

                From our point of view, only the use of resources that does not allow any waste is sustainable. That's why we look for new ways to close the loops every day.

                To rid the planet of plastic waste in the long term, we develop new recycling solutions for plastic raw materials every year. We are also increasing the quality and quantity of secondary raw materials that we produce from plastic waste and offer to industry for further processing.

                To limit global warming to below 2 degrees, global resource consumption must be decoupled from economic growth. To do this, we are closing new material and logistics cycles with which we want to save at least 5 million tons of raw materials and 800,000 tons of CO 2 every year.

                To significantly reduce the per capita environmental impact of waste generation, especially in cities, we are committed to waste avoidance and significantly increasing material recycling rates.

                Take concrete steps to implement our climate strategy

                50% reduction in emissions at our sites by 2025

                Our services are helping customers reduce greenhouse gas emissions and conserve resources. But our commercial activities also produce CO2 emissions. Our goal is to reduce emissions and thus play our role in achieving the climate target set in 2015 at the United Nations Climate Conference, namely to limit the temperature rise to below two degrees Celsius . To do this, we design internal processes and activities to be as neutral, in terms of resource consumption, and efficient as possible. We have used the calculation of our corporate carbon footprint to formulate our climate strategy and specific objectives:

                 

                • 50% reduction in emissions per site (Scope 1 and 2) by 2025
                • Continuous identification of optimization potential in logistics and the goal of reducing logistics-related emissions
                • Annual savings of at least 5.5 million tonnes of resources and 800,000 tonnes of carbon dioxide equivalent thanks to the services offered
